Fitch Affirms Turin Capital Leasing FIDC Ratings ? World Leasing ...

Fitch Affirms Turin Capital Leasing FIDC Ratings

The transaction is backed by a static pool of finance leases originated by Banco CNH Capital S.A. (Banco CNH) to companies and individuals throughout Brazil for heavy equipment. The FIDC consists of a sequential-pay structure of Senior Cotas and unrated Junior Cotas with the legal final maturity in January 2014.

The assets of the fund consist of a pool of 359 highly seasoned equipment leases and liens on the leased equipment. The financings are primarily monthly pay construction equipment leases with a small percentage of mining, forestry and agricultural equipment leases with semi-annual or annual payments. There is no residual exposure.

Credit enhancement is provided to the senior cotas through subordination of the junior cotas and a liquidity reserve. The subordination amount increased from an initial level of 15% to 40% at the end of November, given the sequential-pay amortization structure. The trust also receives enhancement through a limited performance guaranty provided by Banco CNH of up to 15% of the initial collateral balance; however, Fitch gives no credit to this arrangement. Repurchases under this agreement totaled 1.78% of the initial collateral balance through November 2012.

Total credit enhancement is more than sufficient to support loss coverage multiples in excess of the 6,0x base case losses. In addition, the senior class can withstand the default of greater than the top 20 obligors. These stresses are consistent with ratings of ?AAAsf(bra)? and ?A-sf?. The gross loss expectation on the collateral is approximately 2.5% with no credit to recoveries.

Information was provided to Fitch by Banco CNH, BEM DTVM Ltda. and Banco Credit Agricole Brasil.

Additional information is available at ?www.fitchratings.com?. The ratings above were solicited by, or on behalf of, the issuer, and therefore, Fitch has been compensated for the provision of the ratings.

Tribune Co. Leaves Bankruptcy After 4 Years

CHICAGO -- Tribune Co. emerged from a Chapter 11 restructuring Monday, more than four years after the media company sought bankruptcy protection.

The reorganized company is starting with a new board of directors and new ownership that includes senior creditors Oaktree Capital Management, Angelo, Gordon and Co., and JPMorgan Chase and Co.

Tribune closed on a new, $1.1 billion senior secured term loan and a $300 million revolving credit line. The loan will fund payments required under the reorganization plan, and the credit line will fund ongoing operations.

The company also will issue about 100 million shares of class A and class B stock to former creditors, along with warrants to buy the shares. Class B shareholders will have limited voting rights and will not be able to vote for directors.

The new board of directors includes Bruce Karsh, Ken Liang, Peter Murphy, Ross Levinsohn, Craig A. Jacobson, Peter Liguori, and Eddy Hartenstein.

"Tribune emerges from the bankruptcy process as a multimedia company with a great mix of profitable assets, strong brands in major markets and a much-improved capital structure," said Hartenstein, Tribune's chief executive officer.

The Chicago Tribune reported late Sunday that Liguori, a former TV executive at Discovery and Fox, is expected to be named chief executive of the reorganized Tribune Co.

Tribune, which was founded in 1847, publishes some of the best-known newspapers in the United States, including the Los Angeles Times, The Baltimore Sun and the Chicago Tribune. It also owns WGN in Chicago and 22 other television stations, as well as the WGN radio station.

The company sought bankruptcy protection in 2008, less than a year after billionaire developer Sam Zell led an $8 billion leveraged buyout that left the company with $13 billion in debt.

SPORTS: Neah Bay blows out Aussie Travelers at Crush in the Slush; other prep basketball results

PORT TOWNSEND ? Neah Bay dominated the Aussie Travelers from the opening tip and won 79-21 in the Crush in the Slush Tournament at Port Townsend High School on Friday morning.

Tyler McCaulley and Ryan Moss led the offensive onslaught, both drilling five 3-pointers apiece. McCaulley led all scorers with 17 points and Moss had 15.

The Red Devils also got 14 points from Abraham Venske in the win.

After Neah Bay jumped out to a quick 15-2 lead midway through the opening quarter, assistant coach Stan Claplanhoo, who was filling in for head coach Gerrad Brooks, did a five-in, five-out substitution. The Red Devils also pulled back on defense.

?We didn?t show our game today,? Claplanhoo said. ?We usually pressure [on defense] all the time.?

Despite the wholesale changes, Neah Bay continued to roll and finished the quarter with a 26-2 advantage.

The game provide an opportunity to for the Red Devils to play together at full strength.

They were short-handed due to members of the 1B state runner-up football team not having met the required number of practices.

?It was good to get a game in,? Claplanhoo said. ?Some guys? shots are coming around.?

McCaulley is one of those late arrivals finally finding his shooting touch.

?Those shots weren?t falling a week ago,? Claplanhoo said of McCaulley?s hot shooting night.

It was the only game in the Crush in the Slush Tournament for Neah Bay. The Red Devils are off until Tuesday, Jan. 8, when they host Forks, which beat Neah Bay 60-54 earlier this month.

OCEAN SHORES ? A day after suffering their first loss of the season, the Spartans clubbed the Owls on Friday in the North Beach Invitational.

Forks was coming off a 62-59 setback to a hot-shooting Taholah team Thursday.

?It was good after our first loss to come together and not play sporadic,? Forks coach Rick Gooding said.

?It was a great all-around win. Every single player contributed. We got back to playing team basketball.?

Braden Decker followed up a career-high 29 points Thursday with 14 points, nine rebounds and five assists.

Guard Colton Raben shook off a scoreless game to tie Decker with a game-high 14 points.

Leo Gonzales grabbed 13 rebounds and scored 10 points. Mark Jacobson had 10 boards and eight points.

The Spartans? shooting was much better than Thursday when they only made 29 percent of their shots. They doubled that number Friday, shooting 58 percent from the field.

CENTRALIA ? Justice Tasby exploded for 36 points as the Tigers beat the Roughriders for the second time this season on Thursday.

Port Angeles fell behind 27-10 in the first quarter and was unable to get back in the game.

Hayden Gunderson led the Riders with 15 points. He also dished out five assists and pulled down nine rebounds, including four on the offensive end.

Caleb Treider added 13 for Port Angeles, and Garrett Payton and Derek Schumacher scored 12 each. Schumacher also had seven rebound and Payton had six.

Sophomore Hunter Hathaway grabbed nine boards and scored six points.

Although four players scored in double figures, the Riders only shot 34 percent from the field and were just 4 for 26 on 3-point attempts.

?We shot way too many 3s,? Port Angeles coach Brent Stephens said. ?We settled for 3s when we could have taken good two-point shots.?

Port Angeles was without its best post player, Marshall Elliott, who is out for three weeks with a concussion.

They also didn?t have Nathan Angevine and Lambros Rogers, both key members of the Riders? rotation.

Centralia beat Port Angeles earlier this month 92-53.

?We bridged the gap [17 points] from last time,? Stephens said. ?We made it competitive.

?For us to bridge the gap like that without a starter and two other contributing players [shows] we?re improving.?

Sequim 36,
Mornington 29

PORT TOWNSEND ? A 25-point second half helped the Wolves overcome a slow start and beat the Mornington Breakers of Australia in the Crush in the Slush Tournament at Port Angeles High School on Friday morning.

Sequim nearly went the entire first quarter without a point, scoring its first and only bucket with five second remaining in the period.

Any win is a beautiful win for the Wolves, though, especially considering they were without their leading scorer, Alexas Besand, and only senior, Columbia Haupt.

?It?s a big win, especially for our confidence,? Sequim coach Evan Still said.

With those key players missing, Still said the focus was to give playing time to less-experienced players.

Two players typically on the Sequim JV team, Jordan Miller and Judy Villella, were important contributors to the win, especially in the first half when the offense was stagnant.

Villella finished with four points and Miller scored three.

Hailey Lester and Elise Beuke led Sequim with seven points apiece. Emily Wallner added six.

Because they were facing a team from another continent, Sequim had to play without any prior scouting. Therefore, the Wolves had no choice but to keep the game plan simple.

?We just told the girls to play our game, and for the most part we did,? Still said.

QUILCENE ? The Rangers earned a non-league win over the Bruins on Friday behind 15 points, six rebounds and fives steals by freshman Jerrica Viloria.

?Our girls really came together and played as a team,? Quilcene coach Briana Weller said.

?We saw the floor and were able to react to the Bruins? physical play.?

Weller added that tough defense gave the Rangers several fast-break opportunities.

Many Quilcene players contributed to the victory.

Team captain Andrea Lara scored 13 points and tallied five steals.

Sophomore center Sammy Rae had 11 points, 12 rebounds and three blocked shots; freshman Megan Weller had four points, 10 boards, five assists and six steals; and Alex Johnson, yet another freshman, scored two points, grabbed three boards and finished with two steals off the bench.

Zeria Signor led the Bruins with 10 points.

?I was happy with our defense, we had 20 steals as a team,? Clallam Bay coach Kathleen Winter said.

?We had two quarters that we couldn?t make much happen offensively. We had 31 turnovers for the game.?

The Bruins? record is now 4-2 on the season. They start league play Friday at Crescent.

Quilcene improved to 4-5. The Rangers next travel to Seattle on Friday to face Shorewood Christian in a league matchup.

The Best Ways To Market Your Business Online - Maynas Eric

At the present time, your online business needs a strong focus on Internet promotion. Online promotion has become imperative in these times. This can be the perfect time for you to start with Web marketing! Here are some tips that you can use to get you started with your Internet promotion plans.

Coupons are a great way to entice your customers. This can increase customers? appreciation of your products and give them an additional reason to return to your site.

Creating a blog is an excellent method of attracting users to your website. Regularly posting fresh content is a great thing for attracting viewers. Keeping your content fresh and updating it often will help to draw repeat visitors to your site.

TIP! If part of your marketing strategy is to include links in your email communications, make sure you change them up and send new material with each new email. It is all too easy for customers to no longer even see the links that become too familiar.

Make sure your purchasing software uses strong encryption. Opening accounts with a money transfer service, like Paypal, will give you the ability to provide for safe monetary transaction on your site. Before giving you their personal and financial information, you should require users to create a password-protected account.

You are always going to need some sort of tag line and logo, no matter the size of your company. These tools are going to assist with building brand recognition. A customer may remember a good slogan for the long run. When a customer makes up his mind to buy a particular product, the slogan will pop into his or her head, creating a sale for you.

You should be sure to have a place for customers to comment on your products within your site. People like to see what others have said about the product, and they enjoy reading about the experience that someone else had. They will tend to feel safer purchasing from you, as well as feeling more at home on your website.

TIP! To be successful with Internet marketing, have a great site. Check and test your own website regularly to ensure that it is working properly and that there are no glitches or broken links and graphics.

Try to minimize the use of AJAX and Flash so customers are not overwhelmed or bombarded with them on your site. Even though it looks nice, it does not increase your search engine rankings. Only use Flash sparingly. Be sure to add plenty of navigation links and keywords to the pages the use Flash.

A great online marketing technique would be to make a web page that?s main goal is on public relations. A great idea would be to publish articles and content that is interesting and exciting and may end up in a magazine or newspaper. This is a great way to get your business out there for the public to see and is very easy to do.

Your website needs to be as effective as possible in order to increase your marketing success. You can experiment with different layouts and color combinations to see which gives you the best results. Make your site an appealing, pleasant place for people to visit.

TIP! Make your website interesting and beautifully designed. Your website is the first impression of your business.

One piece of internet promotion wisdom some webmasters overlook is to keep websites simple. Multimedia tools like Microsoft Silverlight or Adobe Flash can be tempting to website owner, which is why professional website designers offer this service. They need to also be aware that some visitors cannot use that technology. A website does not need to have a bunch of crazy features, as long as it is efficient and user-friendly.

Capitalize on viral videos to drive a lot of traffic to your site. With just a little creativity and the ability to stretch your imagination, you can put together a video that spans the globe and draws a plethora of visitors. But if you can do it correctly, it will have far more impact on sales than any other type of campaign.

Make your website unique when using Internet promotion. There are billions of websites, so if yours looks like all the others, you won?t make many sales. A good method for doing that is showing off a service you offer that others do not.

TIP! When you are building your website, your goal should be to provide high quality, comprehensive content. You must provide knowledge in a small amount of time so that your prospects understand what they are going to buy.

Offer promotions and incentives to encourage people to come to your website. Offer certain e-books or products for steep discounts for one or two days. When people come to your site to buy the e-book they are likely to take a look around and see what else you have to offer. It is not unusual for such visitors to purchase other things that you have for sale on your website in addition to the e-book.

Now you know why Affiliate marketing is crucial for a successful online business. There are many different ways you can approach this. There is also a lot of information about getting started on the road to success. These hints will boost your venture into internet promotion.

Foursquare to display full user names, share more data with local businesses

Fond of your family name? Good -- it's about to get a bit more visible. Foursquare is planning to display full user names on profile pages, explaining in a recent community email that the old policy has become confusing. "If you search for a friend on Foursquare, we show their full name in the results, but when you click through to their profile page you don't see their last name." The team says these abbreviations made sense in Foursquare's early days, but recently users have been asking for change. "We get emails every day saying that it's now confusing." The social network hopes that displaying users' full surnames will help mitigate confusion between the John Smiths and John Smythes of the world.

The company's tweaked privacy policy promises to share more data with businesses, too, giving store owners greater visibility of customers who have recently checked in. Users who want their quests for coffee to remain anonymous still can, of course -- Foursquare was careful to remind users that they can change their "full name" whenever they want, and can opt out of sharing their location information with businesses. We wouldn't want to step on any toes, would we? Head past the break to see the email for yourself, or check out the adjacent source link to read Foursquare's "Privacy 101" summary.

Android vs. Android: LG looks to ban Samsung tablet in South Korea

Producers of Katie Holmes's Broadway play Dead Accounts, a dark family comedy by Theresa Rebeck, have announced that the show will be closing nearly two months early, wrapping up on January 6 instead of the planned February 24. Obviously the press release about the matter doesn't mention any reasons, but we can assume the show is closing because of poor ticket sales. January is a notoriously difficult frozen tundra for many a Broadway show to traverse, and Dead Accounts just didn't have it. So the cast is being spared the agony of trying. ...

War of Words: Myth-Busting Search Engine Optimization - Online ...

Mythbusting Search Engine Optimization SEOIn last week?s post about myth-busting social media, I asked what other marketing tactic or channel has attracted as much conjecture, blind advocacy and malarkey. ?Only SEO can compare to social media when it comes to the volume of misperceptions and out-dated information posing as ?best practices? online.

They say that the only things you can count on in life are death and taxes. Also, that search engines will change.

Google runs over?20,000 experiments per year and at any given time, 50-200 different versions of Google?s core algorithm are helping billions of searchers find what they?re looking for. ? Add to that, personalization by location, past search history and the influences of the social graph and you have one of the most complex and fast changing systems ever created.

As the final post in my Mythbusting at NMX series (along with Content Marketing?&?Social Media), I?ll address just 3 of the many, many myths about SEO that are polluting and distracting marketers from fully leveraging natural search as part of their online marketing mix.

Myth 1: ?SEO is Dead

There are many who say that Google has made so many improvements to it?s search quality that SEO no longer has any effect on websites in the search results (SERPs). It?s impossible to create cause and effect relationships between perceived ?ranking factors? and positions in the SERPs because each person?s search experience could potentially be different.

SEO is Dead

More than a few pundits say that personalization, social media integration and improvements in combating webspam or manipulation of algorithmic loopholes have rendered the effectiveness of SEO tactics as useless.

Myth Busted:? Claiming SEO is dead is a near national past time for the attention starved.?Many journalists and bloggers make the statement just to stir up the SEO bee?s nest and create online buzz.

For perspective, let?s consider the data: Over 100 billion people search Google every month and marketers spent?$23 billion?on the search marketing in 2012 to attract, engage and convert those searchers into customers. While most of that amount was spent on paid search, billions were spent on SEO. Anything characterized with the word ?billions? doesn?t sound dead to me.

Search is?inseparable?from the experience of using the internet. Search connects you to reputable and trustworthy information, where and when you need it. As long as people are searching and content can be ranked, there will be a demand to optimize.

The practice of SEO is bigger than keywords and links. Essentially,?SEO is Marketing.?Modern, sustainable optimization isn?t about exploiting algorithmic loopholes, it?s a way of thinking that centers around hypothesis, implementation and continuous refinement of performance based on data. ?I?ve written an entire book about a holistic view of optimization that guides marketers from planning to implementation to scale.

Here?s one of the most common examples of this approach: Through a combination of creative keyword research, social topic tracking and insight from web analytics, our team recommended that a company add new content, optimized for new target phrases. Those new pages and digital assets were promoted to attract links and social shares resulting in a new market of customers easily being able to find the client?s services. Optimizing keywords used to discover the content along with testing of offers to provide the most attractive call to action resulted in continued increases in traffic and conversions. Along with the creative and content aspects of SEO, technical optimization best practices are applied at the same time, ranging from increasing page load speed to connecting optimized content with social channels like Google+.

Make no mistake, search engines are far from perfect and they benefit from great SEO work. Modern SEO is art and science, building upon creative and technical skills that make it easy for search engines to find, copy and sort your content in the search results. Modern SEO is also about creating an experience that helps search engines provide people what they?re looking for at the time they need it. Modern SEO consultants provide companies with insight to optimize the performance of their customers? search experience whether the intent is to buy a product or find answers to questions about a product already purchased, so that in the end, everybody wins.

Myth 2: ?SEO Can Only Be Done by SEOs

SEO has it?s roots in the IT and web development field because before there were easy to use content management systems, it took a web developer to make any SEO edits to the company website. There?s a bit of a protectionist culture within IT that has carried on to the SEO community and for good reason. ?Numerous websites have suffered self inflicted disasters from half-informed marketers deciding to make changes to a website without any consideration of the impact with search engines.

A common example is a new web design with less text, fewer pages and a different content management system using say, php instead of asp. For good measure, maybe a new domain name and webhost too. ?Another example is when content is updated on a website and the careful on-page optimization is overwritten by inspired wordsmiths having their way with brand messaging and a healthy dose of metaphors, irony, puns and all around snark. Or what about the decision to copy a competitors tactic of hosting multiple versions of a website on different keyword-hyphenated domains and buying links from other sites to boost PageRank? The competition is doing it, so why can?t we?

Myth Busted:? SEO involves a range of audits including keyword research, technical SEO, content and copywriting, linking and social media. Consulting an experienced SEO practitioner before making major changes to a website is smart. But of the 5 types of audits I mentioned above, many include tasks that can and should be implemented by others in an organization.

This is particularly true with content creation and social community work. With the right training of staff plus ongoing feedback via KPIs and marketing performance, companies can scale optimized content and social media efforts?significantly?with staff that are not trained SEOs.

The practice of SEO has been around over 15 years and while it?s been perceived as a ?dark art? in the past, this is not the case for many SEO best practices. There are abundant sources of smart information about the various disciplines within SEO available on blogs like this one?or on Search Engine Watch, Search Engine Land,?at industry conferences like SES, SMX, and?Pubcon as well as at related events like NMX, Content Marketing World and the new Social Media Marketing World. There?s also the search engines themselves, including Google Webmaster Tools and Bing Webmaster Tools.

Definitely bring a smart SEO in for strategy, for technical issues and for oversight of implementation at regular intervals. Train content creation staff on keyword research, copywriting and content promotion. Arm social media teams with keyword glossaries and knowledge about link building. Help Public Relations staff understand the value of keyword use, social media optimization and links from 3rd party media sources. A team effort is what wins in SEO, not siloed, mystical black box over-promises made by a few individuals.

Myth 3: ?If You Don?t Optimize Your Website, You?ll Never Succeed Online

Billions of people search the web every month looking for exactly what your company offers. Ignoring SEO is akin to making it easier for your customers to do business with the competition. Companies that ignore the sheer volume of interest expressed by prospective customers that are actively looking (through search engines) are doomed to fail.

Myth Busted:? ?About 5 years ago I gave a presentation called, ?How to UnGoogle Your Online Marketing? based on this post in 2006 because so much SEO advice was conflicting and or loopholes inevitably to be closed by Google?s webspam team. The idea was, by implementing tactics as if search engines didn?t exist, marketers could create additional marketing channels and realize the added benefit of better search visibility at the same time.

New companies often consider SEO as a leading strategy, thinking that if they apply SEO best practices they will be able to launch their new company website from scratch and appear at the top of search results. The truth is, new websites should probably focus on advertising and publicity to attract attention since those are methods that can be implemented within a short timeframe and deliver immediate results.?It takes time to develop content that can compete in search and attract both links from other websites and the social interactions that will help the content become ?the best answer? for a competitive query.

A retailer I talked to about the pros and cons of social networking and SEO said something profound: ?I value a new network connection more than a high ranking. Relationships are more important to me than clicks on search results.? ?On one hand, she has a point, but the relationship isn?t worth as much to her business unless they become a customer.

A really simple example of how not explicitly optimizing actually reaps optimized results is the website for my book, Optimize. ?Topics and content were created with the audience in mind with only basic SEO. The site uses the word ?Optimize? in logical places because that?s the name of the book. Promotion of the site was focused on publicity and social channels resulting in mentions on sites like Forbes and?Entrepreneur?Magazine but also showing up in the top 5 for the word ?optimize? out of 122,000,000 search results.?The moral of this story is that there is a time and a place for SEO and that it?s possible earn prominent search visibility without going overboard on SEO tactics

Is it possible to attract, engage and convert customers successfully without employing a SEO program? ?Yes. ?Is it easier? No. ?Would it be better to implement SEO best practices from day one and leverage other ?UnGoogle? channels to attract traffic? Absolutely.

This series is a preview to my presentation at the NMX?conference (BlogWorld) on January 8th (Tuesday) at the Rio in Las Vegas.?Here?s the official session description:

'Thunderbirds' creator Gerry Anderson dies

By Reuters

Gerry Anderson, the British creator of popular television show "Thunderbirds," died on Wednesday age 83 after a long battle with dementia, his son said on his blog.

Chris Ware / Getty Images file

"I'm very sad to announce the death of my father, 'Thunderbirds' creator Gerry Anderson. He died peacefully in his sleep at midday today ... having suffered with mixed dementia for the past few years," Anderson's son Jamie wrote.

The puppeteer started his television career in the 1950s, creating a string of popular British shows including 1964's "Stingray" and 1967's "Captain Scarlet and the Mysterons."

His company AP Films pioneered the "supermarionation" puppetry technique with the fusion of marionette figures and small-scale models to create live action-style shows.

Anderson's most notable production was 1965 series "Thunderbirds," featuring marionette puppets, about a secret organization that performs rescue missions using high-tech tools and vehicles, with characters such as ex-astronaut Jeff Tracy and agent Lady Penelope.

While the show only aired for two seasons on British television, it became a cult favorite and was adapted for the big screen, most recently in 2004 film "Thunderbirds," with the voices of Ben Kingsley and Bill Paxton.

Anderson is survived by his wife Mary and four children.

HONOLULU (AP) ? Hawaii's lieutenant governor and former head of President Obama's 2008 election effort there has been named the state's newest U.S. senator, a choice that went against the dying wish of revered longtime Sen. Daniel Inouye.

Gov. Neil Abercrombie appointed Brian Schatz to the post Wednesday, instead of Inouye choice U.S. Rep. Colleen Hanabusa.

The 40-year-old Schatz, a former state representative and onetime chairman of the state Democratic party, said his top priorities would be addressing global climate change, preserving federal funds used in Hawaii for things like defense spending and transportation, and getting federal recognition for Native Hawaiians for forming their own government, similar to many Indian tribes.

Schatz, who ran with Abercrombie for the state's top two offices in 2010, beat out Hanabusa and Esther Kiaaina, a deputy director in the state Department of Land and Natural Resources.

The three candidates were selected by state Democrats Wednesday morning from a field of 14. The candidates briefly made their cases before the state party's central committee.

"No one can fill Sen. Daniel K. Inouye's shoes, but what we want to do today is find the right person to walk in his footsteps," Schatz told the committee.

"I want to be your senator because I believe Hawaii needs seniority, and we need someone who can build it up over decades and decades. And I pledge to you, if I'm given this opportunity and obligation to serve, I will try to make this my life's work and rebuild the tenure that Hawaii so desperately needs," he said.

The White House said Schatz would fly to Washington Wednesday night with Obama, who was returning from his Hawaii Christmas vacation early as Congress considers what to do about the so-called fiscal cliff.

Schatz could be sworn in as early as Thursday, which would make him Hawaii's senior senator. Hawaii's other senator, Daniel Akaka, is retiring at the end of this Congress after 22 years.

Even before winning the 2010 general election, Abercrombie expressed faith in Schatz, saying he would put him in charge of attracting more private and federal investment in Hawaii. Other responsibilities included leading the state's clean energy efforts and Asia-Pacific relations.

"To the people of Hawaii, I can assure you this: I will give every fiber of my being to doing a good job for the state of Hawaii," Schatz told a news conference in Honolulu. "We have a long and perhaps difficult road ahead of us, but we can succeed if we work together. I understand the magnitude of this obligation and this honor, and I won't let you down."

Inouye, by far Hawaii's most influential politician and one of the most respected lawmakers in Washington after serving five decades in the Senate, died last week of respiratory complications at the age of 88. He sent Abercrombie a hand-signed letter dated the day he died, saying he would like Hanabusa to succeed him, calling it his "last wish."

Four days after eulogizing Inouye in the courtyard of the Hawaii Capitol, Abercrombie said he had to consider more than just Inouye's wishes in filling his seat.

"Of course Sen. Inouye's views and his wishes were taken into account fully, but the charge of the central committee, and by extension then myself as governor, was to act in the best interests of the party ... the state and the nation," Abercrombie said.

"The law makes explicitly clear, as do the rules of the Democratic Party, that while everyone's voice is heard and everyone's view is taken into account, nonetheless, no one and nothing is preordained."

Under state law, the successor had to come from the same party as the prior incumbent. An Abercrombie spokeswoman said the governor did not feel any political pressure from within his party to make the choice he made.

"While we are very disappointed that it was not honored, it was the governor's decision to make," Jennifer Sabas, Inouye's chief of staff, said in a statement. "We wish Brian Schatz the best of luck."

Selecting Hanabusa, 61, would have required a special election in Hawaii's 1st Congressional District. Last time that happened, Hanabusa lost to Republican Charles Djou because of a winner-take-all format that split votes between Democrats.

Abercrombie said the possibility of a special election was a factor, as well as Hanabusa's "key position" on the House Armed Services Committee. The governor said she was on her way toward establishing a senior position on that panel, and it's important for Hawaii ? with its four-member delegation ? to establish seniority in both chambers.

Schatz will serve until an election is held in 2014. He said he will run for re-election to try to keep the Senate seat until 2016 ? the end of Inouye's original term ? and would run again for Senate in 2016 if given the chance.

Hanabusa congratulated Schatz in a statement.

"Having served as chair of the Hawaii Senate Judiciary Committee when the succession law was passed, I fully respect the process and the governor's right to appoint a successor," she said.

Last week, when Abercrombie announced he would not seek the seat himself, his spokeswoman Louise Kim McCoy said Abercrombie intends to make his current post as Hawaii governor the last office of his political career.

Inouye would be "very happy" with the choice, Hawaii Democratic Party chairman Dante Carpenter said. Schatz has less experience than some older politicians in the Senate but he will be building seniority, which is "critical" to the state of Hawaii, he said.

"In the words of Sen. Dan Inouye ? invoked more than once ? seniority in the United States Congress is everything," Carpenter said.

Senate Majority Leader Harry Reid had urged Abercrombie to name Inouye's successor before the end of the year. The next Congress begins Jan. 3.

Democratic Rep. Mazie Hirono, D-Hawaii, was elected in November to succeed Akaka.

First in line to replace Schatz as lieutenant governor is Senate President Shan Tsutsui, who said he planned to discuss the prospect with his family before deciding.

Three Quick and Easy Ways to Quiet Your Mind

Three Quick and Easy Ways to Quiet Your MindNeuroscience tells us that, to be more productive and creative, we need to give our brains a break. It's the quiet mind that produces the best insights. But it's a challenge to take that sort of time off in the midst of a busy day. Here are three specific, quick, and easy ways to build purposeful break time into your day.

Quick Meditation

New research from the UCLA Laboratory of Neuro Imaging suggests that people who meditate show more gray matter in certain regions of the brain, show stronger connections between brain regions and show less age-related brain atrophy. In other words, meditation might make your brain bigger, faster, and "younger". As lead researcher Eileen Luders explains, "it appears to be a powerful mental exercise with the potential to change the physical structure of the brain."

Tip: If you commute via public transportation (or even if you're a passenger in a car pool) use the time to close your eyes for 10 minutes. If you drive, leave a little early, park, and spend 10 minutes in the car before you walk into work. Choose a very specific image, such as a waterfall, beach, or tree, and try to focus on it alone. If other thoughts get in the way, gently push them aside. Do this once or twice per day. The goal is to let your mind achieve a sense of relaxed awareness.

Pulsing

Psychologist K. Anders Ericsson, renown for his research and theories on expertise, points out that top performers in fields ranging from music to science to sports tend to work in approximately 90-minute cycles and then take a break. We are designed to pulse, to move between spending and renewing energy. Pulsing is the simplest, easiest, most immediate way to build breaks into your day.

Tip: Download a "break-reminder" utility, such as Scirocco or Healthy Hints, and set it to ping you every 90 minutes. Focus hard on a particular task until that cue. And then take a walk, talk to a colleague, doodle, or listen to music. Do anything that renews you and gives you a "second wind," even if you think you don't need it. You do. Five minutes later, get back to work.

Daydream Walks

Most people have heard the story about how 3M's Arthur Fry came up with the idea for the Post-it note: he was daydreaming in church. Jonathan Schooler, a researcher at UC Santa Barbara, has repeatedly shown that people like Fry who daydream and let their minds wander score higher on creativity tests. What separates this from meditation is that, instead of emptying your mind, you're letting it fill up with random thoughts. The trick is to remain aware enough to recognize a sudden insight when it comes.

Tip: Start by taking 20 minutes, two days a week during your lunch break to take a stroll and daydream. Think about anything you want besides work?a beach vacation, building your dream house, playing shortstop for the Yankees, whatever. Ramp it up to three or four days a week. The next time someone catches you daydreaming on the job and asks you why you're not working, tell them that in fact you're tapping into your creative brain.

Capitol Christmas Gifts

There are several rules that govern what members of congress can receive as holiday gifts There are several rules that govern what members of congress can receive as holiday gifts

Photograph by Shironosov/iStockphoto.

Most Americans have finished opening their Christmas presents, but the holiday season has one Explainer reader wondering about his less fortunate representative in the U.S. Congress. Do Ethics Committee limits on gifts prevent federal legislators from participating in Christmas?

Not really. Anyone can give a single gift worth less than $50 to a member of Congress, so feel free to send stocking stuffers to your man or woman in Washington. Gifts from family members are also exempt from ethics rules, at any value, so a member of Congress (or his or her staff) can have an old-fashioned family Christmas without risking censure. There is a potential for trouble, however, when it comes to friends. A legislator?s neighbor, girlfriend, or boyfriend can give a gift of up to $250 without triggering the interest of the House or Senate Ethics Committees. For gifts in excess of that amount, the Ethics Committees decide whether the member of Congress may accept the present. Legislators must disclose how they know the gift-giver, his or her line of work, and whether anyone else might be contributing to the cost of the present. (The Ethics Committees also consider whether the donor plans to deduct the cost of the gift on tax filings?a strong indication that the donor thinks of it as more than a gift of friendship.) The gift-giving rules have a soft spot for true love: Fianc?s and fianc?es are treated as family, making it possible for a member of Congress to accept an engagement ring.

The rules might complicate the holidays for our representatives in Washington, but they?re easy enough to follow. Since 2007, when the gift-giving rules were updated, no legislator has been punished for accepting a Christmas gift. The Ethics Committees do receive dozens of calls around the holidays requesting an opinion on certain situations. (If, for example, a legislator?s childhood friend is now a lobbyist, it can make Christmas a tricky time.) Potential consequences range from private admonishment to a fine. The committees consider such factors as the willfulness and egregiousness of the violation when crafting a punishment.

The biggest challenge for members of Congress this time of year isn?t physical gifts but receptions. Lobbyists love to throw soirees during the holiday season for the legislators they?re trying to influence. A regulation known derisively among lobbyists as the ?toothpick rule? limits how ritzy these affairs can be. Legislators are not allowed to attend formal dinners but may drop in on events in which finger foods or food on a toothpick is served. So lobbyists work hard to create fancy events in which forks and knives are not required. Recently, a liquor lobbying group threw a clever party called ?Bacon and Bourbon.?

Police investigate whether NBC's Gregory violated gun law

Washington police are investigating whether NBC's David Gregory broke the law by holding up what appeared to be a 30-round gun magazine on Sunday's Meet the Press despite being denied permission by police to bring the weaponry on the show.

It is illegal in the district to possess a "large capacity ammunition feeding device."

Gwendolyn Crump, director of the Office of Communications for the Washington Metropolitan Police Department, told ABC News, "NBC contacted MPD inquiring if they could utilize a high capacity magazine for their segment. NBC was informed that possession of a high capacity magazine is not permissible and their request was denied. This matter is currently being investigated."

Another Washington DC police officer and spokesperson Tisha Gant said the situation was "being investigated," but would give no other details including what exactly is under investigation.

A section in the D.C. criminal code says "no person in the District shall possess, sell, or transfer any large capacity ammunition feeding device regardless of whether the device is attached to a firearm." The section stipulates that "the term large capacity ammunition feeding device means a magazine," or similar devices.

Gregory held up what looked like a 30-bullet gun magazine when interviewing the National Rifle Association's executive vice president and CEO Wayne LaPierre on Sunday. Gregory pressed the NRA head on whether fewer children would have been killed during the Sandy Hook Elementary shooting on Dec. 14th if the shooter had access to less ammunition.

Since the interview, conservative media and gun rights activists said that Gregory appeared to have violated the district's gun law. Police subsquently confirmed they were investigating.

NBC News declined to comment through a spokesperson.
