New Orleans police on Wednesday booked a 38-year-old man with participating in the gang rape of a woman at an Algiers apartment on April 11, 2001. Max J. Clayton was jailed on one count of aggravated rape after his DNA matched evidence recovered from the victim, investigators said.
On the day the woman was attacked, she heard a knock at the front door of a friend's apartment in the 3300 block of Garden Oaks Drive about 8:30 a.m. When she answered the door, a stranger pointed a handgun at her head, forced her back inside and ordered her to disrobe, police said.
The gunman then demanded that the woman lie face down on the floor. He and about six other men then raped her and fled, the victim told police. The woman went to a hospital and underwent a sexual assault examination.
On July 25, 2011, Detective Randi Gant of the NOPD's Sex Crimes Unit received a letter from the Louisiana State Police crime lab that evidence from the rape matched a profile of Clayton stored on the CODIS database, a collection of DNA samples of people convicted of crimes. Clayton had previously pleaded guilty to forgery and auto theft in New Orleans, records show.
Gant spoke with the victim by telephone three days later. The woman said she did not know Clayton or ever consent to having sex with him.
Gant obtained a warrant to arrest Clayton on Aug. 12, 2011. It is not clear why he wasn't taken to jail until Wednesday, but documents list his address as being in Lake Charles.
Clayton's bail on the aggravated rape accusation was set at $200,000. That crime carries a sentence of mandatory life imprisonment upon conviction.
